NOTICE OF SUBSTITUTE TRUSTEE’S SALE  

 

WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of  Trust dated October 23, 2008, executed by REBECCA DAVIS, A SINGLE WOMAN, conveying certain  real property therein described to GREG A ZISKIND as same appears of record in the Register’s Office  of Tipton County, on October 28, 2008, as Instrument No. 122305, in Book 1415, at Page 859; and  

WHEREAS, the beneficial interest of said Deed of Trust was last transferred and assigned to BANK OF  AMERICA, N.A., SUCCESSOR BY MERGER TO BAC HOME LOANS SERVICING, LP FKA  COUNTRYWIDE HOME LOANS SERVICING, LP, who is now the owner of said debt; and  

WHEREAS, Notice of the Right to Foreclose(“Notice”) was given in compliance with  Tennessee law by the mailing a copy of the Notice to the parties at least sixty (60) days prior to  the first publication of the Substitute Trustee’s Sale.    

WHEREAS, the undersigned, RECONTRUST COMPANY, N.A., having been appointed by as Substitute Trustee by instrument filed for record in the Register’s Office of Tipton County, Tennessee.

NOTICE OF SALE OF REAL ESTATE

 

WHEREAS, by Deed of Trust dated January 27, 2006, and recorded on February 10, 2006, appearing of record in Record Book 1258, page 393  in the Register’s Office of Tipton County, Tennessee, Alaa Eldin Noeman, Raid Tabbaa, Chhem Botomsreyroth conveyed to MATTHEW DANIELS, TRUSTEE, certain real estate therein described, to secure the payment of a certain indebtedness therein set forth to Clayton Bank and Trust, Covington Friendship Division, Covington (now Clayton Bank and Trust); and an Assignment of Leases and Rents dated January 27, 2006, recorded on February 10, 2006 in Record Book 1258, page 407 in said Register’s Office.

WHEREAS, default has been made in the payment of the indebtedness secured by the Trust Deed, and Clayton Bank and Trust the lawful holder of the note evidencing the indebtedness has declared the entire balance due and payable; and
