TRUSTEE’S SALE

 

Default having been made in payment of the debts and obligations to be paid by JAMES V. OWEN, SR. as shown in a certain Deed of Trust dated the 30th day of September, 2002, to DONNA DOWNING, as Trustee, as the same appears of record in the Office of the Register of Tipton County, Tennessee, in Book 1025, Page 127, as modified by Extension and Modification Agreements of record in Book 1370, Page 910, Book 1567, Page 684, and Book 1748, Page 305; and

BRIGHTON BANK, the owner of the debt secured, having requested the undersigned to advertise and sell the property described in and conveyed by said Deed of Trust, all of said indebtedness having matured by default in the payment of a part thereof, at the option of the owner, this is to give notice that DONNA DOWNING will on Friday, September 6, 2019, commencing at 12:00 p.m. at the north door of the Tipton County Courthouse, Covington, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property, to-wit:

Situated in the County of Tipton and State of Tennessee:

Tract I:

Beginning at a point in the centerline of the Brighton-Clopton Road, said point being the southeast corner of Audrey Higgins’ lot, recorded in Deed Book 525, Page 514, in the Register’s Office of Tipton County, Tennessee, and the northeast corner of P.D. Farrington’s lot of which this lot, now being described, is a portion; runs thence with the centerline of the Brighton- Clopton Road as follows: South 21° 12’ 36” East, 44.83 feet to an existing cotton spindle; thence South 15° 09’ 27” East, 48.01 feet to a point; thence South 10° 01’ 34” East, 60.88 feet to a cotton spindle, Farrington’s new northeast corner and subject lot’s southeast corner; thence with Farrington’s new north line and subject lot’s south line, North 89° 12’ 37” West, 225.78 feet to a steel post in Norman Anderson’s east line and Farrington ‘s original west line, said point being Farrington’s new northwest corner and subject lot’s southwest corner; thence with Anderson’s east line and Farrington’s original west line, North 01° 40’ 51” East, 6.93 feet to an existing iron pin, Higgins’ southwest corner and Farrington’s original northwest corner, said point being subject lot’s northwest corner; thence with Higgins’ south line and Farrington’s original north line, North 53° 26’ 43” East, 231.79 feet to the point of beginning and containing 0.41 acre, more or less.

Beginning at a point in the centerline of the Sawmill Road, said point bein Norman Anderson’s Southeast corner and P.D. Farrington’s southwest corner of which this lot, now being described, is a portion, runs thence with Anderson’s east line and Farrington’s original west line, North 1° 40’ 51” East, 137.22 feet to an existing steel post, the southwest corner of Tom Baker’s lot and Farrington’s northwest corner; thence with Baker’s south line and Farrington’s north line, South 89° 12’ 37” East, 113.50 feet to a stake, subject lot’s northeast corner and the northwest corner of Farrington’s remaining 0.40 acre lot; thence with the west line of Farrington’s 0.40 acre lot and parallel to Anderson’s east line, South 1° 40’ 51” West, 140.56 feet to a point in the centerline of Sawmill Road, subject lot’s southeast corner and the southwest corner of Farrington’s 0.40 acre lot; thence with the centerline of Sawmill Road, North 87° 31’ 23” West, 113.50 feet to the point of beginning and containing 0.36 acre, more or less.

Tract III:

Beginning at an existing cotton spindle in the centerline of the Brighton-Clopton Road, said point being the southeast corner of Tom Baker’s lot and the northeast corner of P.D. Farrington’s lot of which this lot, now being described, is a portion, runs thence with the centerline of Brighton-Clopton Road as follows: South 6° 29’ 01” East, 62.41 feet to a point; thence South 3° 26’ 36” East, 82.64 feet to a point in the intersection of the centerline of the Brighton-Clopton Road with the centerline of the Sawmill Road; thence with the centerline of the Sawmill Road, North 87° 31’ 23” West, 128.53 feet to a point, the southeast corner of Farrington’s remaining

0.36 acre lot and subject lot’s southwest corner; thence with the east line of Farrington’s 0.36 acre lot and subject lot’s west line, North 1° 40’ 51” East, 140.56 feet to a stake in the south line of Baker’s lot and Farrington’s original north line, the northeast corner of Farrington 0.36 acre lot and subject lot’s northwest corner; thence with Baker’s south line and Farrington’s original north line, South 89° 12’ 37” East, 112.28 feet to the point of beginning and containing 0.40 acres, more or less.

Tract IV:

Being all that portion of Grant’s property lying east of the Brighton-Clopton blacktop road. This is very small area containing only a fractional part of an acre.

However, these is to be excepted out of the above-described lot all that part occupied by the Brighton-Clopton Road and the Sawmill Road as their rights of way.

This being the same property conveyed to James V. Owen, Sr. and wife, Frances A. Owen by Warranty Deed of record at Book 1025, Page 124, in the Register’s Office of Tipton County, Tennessee. Frances A. Owen died on or about April 26, 2011, leaving James V. Owen, Sr. as her surviving tenant by the entirety.

All right and equity of redemption, statutory and otherwise, homestead and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Trustee. Sale made subject to lien for unpaid City and County property taxes; and any rights of existing tenants. The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.
