NOTICE OF TRUSTEE’S SALE

 

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated 06/10/2009, and the Deed of Trust of even date securing the same, recorded 06/12/2009, in Instrument No. 128812; Book 1441 Pages 331-337, in Office of the Register of Deeds for Tipton County, Tennessee, executed by Jeremy Blake Fiveash, conveying certain property therein described to Robert G. Connelly Jr., Acting State Director as Trustee for USDA Rural Development, as nominee for Rural Housing Service, U.S. Department of Agriculture, its successors and assigns; and the undersigned, The Sayer Law Group, P.C., having been appointed Successor Trustee by Robert G. Connelly Jr., Acting State Director, as trustee for Rural Housing Service, U.S. Department of Agriculture.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of The Sayer Law Group, P.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Robert G. Connelly Jr., Acting State Director, as trustee for Rural Housing Service, U.S. Department of Agriculture, will, on 07/05/2019 on or about 12:00PM, at the  Tipton County Courthouse, 1801 South College Street, Covington, TN, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Tipton County, Tennessee, and being more particularly described as follows:

Being Lot 1 of the Atoka View Estates Subdivision recorded in Plat Cabinet H, Slide 50B, also being the Aaron Coffey tract recorded in Deed Book 1225, Page 167 in the Register’s Office, lying on the west side of Portersville Road in the Seventh Civil District of Tipton County, Tennessee, being more particularly described as follows:

Beginning at an iron pin found at the northeast corner of Lot 1 of the Atoka View Estates Subdivision recorded in Plat Cabinet H, Slide 50B, said point being on the west right-of-way line of Portersville Road (68’ R.O.W. Dedication); then along the said right-of-way line the following two courses: South 23 deg. 35’ 35” East, 162.91 feet to a point of curvature; South 22 deg. 04’ 02” East along the chord of a 791.00’ radius curve to the right an arc length of 45.03 feet to an iron pin found; then South 67 deg. 36’ 55” West, 342.96 feet long the north line of Lot 2 of the Atoka View Estates Subdivision to an iron pin found; then North 07 deg. 39’ 07” East, 240.20 feet along the east line of the Jeremy B. Harris tract DB 1328, PG 499) to an iron pin found; then North 67 deg. 37’ 51” East, 219.53 feet along the south interior line of the said Jeremy B. Harris tract to the Point of Beginning.

This conveyance is subject to subdivision restrictions in Book 116, Page 81, and building lines and easements in Plat Cabinet H, Slide 50-B, in the Register’s Office of Tipton County Tennessee.

This above property description is from a survey performed by Raymond E. Pittman, a registered land surveyor for the State of Tennessee, Tennessee Registration # 1414, survey dated May 28, 2009.
