NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated 08/20/2009, and the Deed of Trust of even date securing the same, recorded 08/26/2009, in Instrument No. 130996 Record Book 1449 Page 704-710, in Office of the Register of Deeds for Tipton County, Tennessee, executed by Alvin Holland Jr. and Jessica Holland, conveying certain property therein described to Robert G. Connelly Jr., Acting State Director as Trustee for USDA Rural Development, as nominee for Rural Housing Service, U.S. Department of Agriculture., its successors and assigns; and the undersigned, The Sayer Law Group, P.C., having been appointed Successor Trustee by Robert G. Connelly Jr., Acting State Director, as trustee for Rural Housing Service, U.S. Department of Agriculture..
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of The Sayer Law Group, P.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Robert G. Connelly Jr., Acting State Director, as trustee for Rural Housing Service, U.S. Department of Agriculture., will, on 08/06/2019 on or about 12:00 PM, at the Tipton County Courthouse, 1801 South College Street, Covington, TN, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Tipton County, Tennessee, and being more particularly described as follows:
Lot 180, Park Place Subdivision, Section E as recorded in Plat Cabinet E, Slide 181, in the Register’s Office of Tipton County, Tennessee, being situated in the City of Munford, Tennessee and being more particularly described as follows:
Beginning at a set 1/2 inch rebar with cap in the south R.O.W. line of Connecticut Avenue (50 foot R.O.W.) being 170.22 feet east of the east R.O.W. line of Chance Street and being the northeast corner of Lot 179, also being the northwest corner of Lot 180; thence North 89 degrees 16 minutes 42 seconds East, along the south R.O.W. line of Connecticut Avenue, a distance of 85.01 feet to a set 1/2 inch rebar with cap being the northwest corner of Lot 181, also being the northeast corner of Lot 180; thence South 00 degrees 05 minutes 25 seconds west, a distance of 110.12 feet to a found 1/2 inch rebar with cap in the north line of Lot 175 being the southwest corner of Lot 181, also being the southeast corner of Lot 180, and passing a found 1/2 inch rebar with cap being the northwest corner of Lot 175 at 37.80 feet and continuing for a distance of 85.12 feet to a found 1/2 inch rebar in the north line of Lot 176 being the southwest corner of Lot 179, also being the southwest corner of Lot 180; thence North 00 degrees 05 minutes 25 seconds East, a distance of 113.35 feet to the point of beginning and containing 0.22 acres, more or less.
There is a one-story brick and frame residence located on this lot as shown on plat of survey known as # 145 Connecticut Avenue, Sip: 38058.
There is a 10 foot utility easement located along the north line and south line of this lot as shown on the recorded plat.
This property does not lie in a Special Flood Hazard Area as per flood lines established by FEMA and is designated as Zone X on firm map # 47167CO150-E, dated 04/02/1991
