WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust dated November 13, 2014, executed by William Allen Hensley, an unmarried man, to Charles M. Ennis, Trustee, for Mortgage Electronic Registration Systems, Inc., as nominee for Patriot Bank, its successors and assigns, and appearing of record on November 17, 2014, in the Register’s Office of Tipton County, Tennessee, at Book 1639 Page 743 and Instrument Number 181450.

WHEREAS, the beneficial interest of said Deed of Trust was last transferred and assigned to U.S. BANK NATIONAL ASSOCIATION, the party entitled to enforce said security interest; and having appointed Clear Recon LLC, the undersigned, as Substitute Trustee by instrument filed or being filed for record in the Register’s Office of Tipton County, Tennessee, with all of the rights, powers, and privileges of the original Trustee named in said Deed of Trust.  

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust, and that the undersigned, Clear Recon LLC, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty, and authority vested and imposed upon said Substitute Trustee will, on June 3, 2019, at 10:00 AM, local time, at the North Door of the Tipton County Courthouse, located in Covington, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, paid at the conclusion of the sale, the following described property situated in Tipton County, to wit:

The land referred to herein below is situated in the County of Tipton, State of Tennessee, and is described as follows:

Being Lot 23 of Green Hill Subdivision to Tipton County, Tennessee, plat of which is of record at Plat Book 1, Page 45 and 49 of the Register’s Office of Tipton County, Tennessee, and said lot is thus described:

Beginning at a stake in the west right of way of Kimbrough Drive, (having a 50 foot right of way, said stake being the southeast corner of Lot No. 24 and the northeast corner of Lot 23, now being surveyed; runs thence with the south line of Lot No. 24 west 150.00 feet to a stake in the east right of way of a 14 foot abandoned lane, said stake being the southwest corner of Lot No. 24, and the northwest corner of Lot No. 23; thence with the east line of the abandoned land south 100.00 feet to a stake at the northwest corner of Lot No. 22; thence with the north line of Lot 22, east 150.00 feet to a stake being the northeast corner of Lot No. 22; thence with the lane north 100.00 feet to the beginning, according to a survey of Milton Thornton, under date of November 12, 1968, and being a part of the same real estate conveyed to Green Hills, Inc. by R.A. Being the same property conveyed to William Allen Hensley by deed of record in Book 1639, Page 741, in the Register’s Office of Tipton County, Tennessee.

The transfer shall be AS IS, WHERE IS, AND WITH ALL FAULTS, and without warranties of any kind, express or implied, as to the condition of the Property and the improvements located thereon, including merchantability or fitness for particular purpose.  Trustee shall make no covenant of seisin or warranty of title, express or implied, and will sell and convey the subject real property by Substitute Trustee’s Deed only. 

The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. 

This property is being sold with the express reservation that the sale is subject to confirmation by the lender or trustee. This sale may be rescinded by the Substitute Trustee at any time.
