NOTICE OF SUBSTITUTE TRUSTEE’S SALE
WHEREAS, Charles Ward Dotson and Wife Melaine Dawn Dotson as joint tenants by Deed of Trust (the “Deed of Trust”), dated July 24, 1996 and of record in Deed Book 776, Page 699, Register’s Office of Tipton County, Tennessee, conveyed to Thomas Staten, Sumner Co., Brenda Archbold, Sumner Co or Phyllis Miller, Davidson Co., Trustee, the hereinafter described real property to secure the payment of a certain Promissory Note (the “Note”) described in the Deed of Trust, which Note was payable to Secretary of Veterans Affairs, an Officer of the United States of America, as last transferred to Deutsche Bank National Trust Company, as Trustee of Vendee Mortgage Trust 1996-3 by Assignment recorded in Record Book 1807, Page 860, Tipton County, Tennessee records, and
WHEREAS, Mantenn, LLC has been duly appointed Substitute Trustee by the owner and holder of the Note by instrument recorded in Deed Book 1810, Page 217, Tipton County, Tennessee
WHEREAS, default has been made in the payment of the Note; and
WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of the indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust. The notice requirements of T.C.A. §35-5-117 have been satisfied.
NOW, THEREFORE, notice is hereby given that an agent of Mantenn, LLC, Substitute Trustee, pursuant to the power, duty, and authority vested in and conferred by the Deed of Trust, will October 9, 2019, at 12:00 p.m. at the north door of the Tipton County Courthouse in Covington, Tennessee, be sold to the highest call bidder for cash free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Tipton County, Tennessee, described as follows:
Described property located in Tipton County, Tennessee, to wit: Being Lot 36 of Hilltop Subdivision as recorded at Plat Book 1, Page 67, of the Register’s Office of Tipton County, Tennessee, and being more particularly described as follows: Beginning at a found iron post being the southeast corner of Lot 36 of Hilltop Subdivision, Plat Book 1, Page 67, also being the northeast corner of Lot 9 of said subdivision, also being an angle point in the west line of Lot 10 of said subdivision; thence in a southwestwardly direction, along the south line of Lot 36, also being the north line of Lot 9 and a north line of Lot 8 of said subdivision, South 87 degrees 00 minutes 00 seconds West, a called distance of 215.30 feet, but a measured distance of 215.66 feet to a found iron post being the southwest corner of Lot 36 and the northwest corner of Lot 8, also being in an east line of the Jean C. Doyle property, Deed Book 559, Page 162; thence in a northwestwardly direction, along the west line of Lot 36 and the east line of the Doyle property, north 03 degrees 33 minutes 12 seconds West, a called distance of 466.00 feet, but a measured distance of 462.35 feet to the northwest corner of Lot 36, also being the northeast corner of the Doyle property, also being in the centerline of Brighton Clopton Road; thence in a northeastwardly direction, along the centerline of Brighton Clopton Road, also being the north line of Lot 36, North 87 degrees 14 minutes 23 seconds East, a distance of 220.00 feet to the northeast corner of Lot 36 and the northwest corner of Lot 35 of said subdivision; thence in a southeastwardly direction, along the east line of Lot 36 and the west line of Lot 35, south 03 degrees 00 minutes 55 seconds East, passing a found iron post at 23.24 feet and passing a found iron post at 361.43 feet being the southwest corner of Lot 35 and the northwest corner of Lot 10 and continuing along a west line of Lot 10, in all a called distance of 466.00 feet, but a measured distance of 461.41 feet to the point of beginning.
This conveyance is made subjection to the following:
1. Subdivision restrictions, easements and building lines of record in Plat Book 1, Page 67, Register’s Office for Tipton County, Tennessee.
2. Easements of record as shown in Book 305, Page 600, Register’s Office for Tipton County, Tennessee.
Being the same property conveyed to Grantor by deed from Jesse Brown, Secretary of Veterans Affairs, dated July 19, 1996, being recorded simultaneously herewith in the Register’s Office of Tipton County, Tennessee.
The street address of the above described property is believed to be 5605 Brighton Clopton Road, Brighton, TN 38011, but if such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose.
All right of equity of redemption, statutory and otherwise, and homestead are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
