NOTICE OF SUBSTITUTE TRUSTEE’S SALE

 

Sale at public auction will be on June 24, 2019 at 11:00 AM, at the Tipton County Courthouse (TN) located in Covington, Tipton County, Tennessee, pursuant to Deed of Trust executed by Heather Pennington, to Mary Ruth Tackett, Trustee, as trustee for United States of America acting through the Rural Housing Service or successor agency, United States Department Of Agriculture on 21st day of June, 2006 in REC Book 1282, Page 518  at Instrument Number 89857, in the Office of the Register of Tipton County, Tennessee; conducted by Terra Abstract Tennessee, Inc., having been appointed Substitute or Successor Trustee. Default has occurred in the performance of the covenants, terms, and conditions of said Deed of Trust and the entire indebtedness has been declared due and payable.

Beginning at the northeast corner of the George Smith lot as recorded in Deed Book 519, Page 224, also being the northwest corner of Antonio Lopez 491/380) and being in the south r.o.w. line of Highway 59; thence in a southeastwardly direction, along the east line of Smith and the west line of Lopez, S 18 deg. 14` 05” E, a called and measured distance of 150.00 feet to a found iron post at the southeast corner of Smith, also being the southwest corner of Lopez and being in the north line of Blankenship, thence in a southwestwardly direction, along the south line of Smith and the north line of Blankenship S 72 deg. 00` 00” W, a called and measured distance of 100.00 feet to the southwest corner of Smith, also being the southeast corner of James Chumley, Jr. (568/24); thence in a northwestwardly direction, along the west line of Smith and the east line of Chumley N 18 deg. 14` 05” W, a called and measured distance of 150.00 feet to the northwest corner of Smith, also being the northeast corner of Chumley and being in the south line of Highway 59; thence in a northeastwardly direction, along the south line of Highway 59, N 72 deg. 00` 00” E, a called and measured distance of 100.00 feet to the point of beginning and containing 0.34 acres, more or less.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose.
