NOTICE OF FORECLOSURE SALE

WHEREAS, Joseph Taylor executed a Deed of Trust to American Mortgage Services, Inc., Lender and Monte S. Connell, Trustee(s), which was dated April 2, 2004, and recorded on April 14, 2004 in Book 1133, Page 212, Instrument Number 55863 in Tipton County, Tennessee Register of Deeds.

WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, SunTrust Bank, (the “Holder”), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on September 10, 2019, at 10:00AM at the usual and customary location at the Tipton County Courthouse, Covington, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Tipton County, Tennessee, to wit:

Property lying and being in the 5th Civil District of Tipton County, Tennessee and being more particularly described as follows: 

Beginning at a point in the northwest line of Perry Road, said point being the southeast corner of the herein described property, also being the northeast corner of the J.T. Epps property (Deed Book 494, Page 428); thence along said Epps northeast line, North 48 degrees 14 minutes 17 seconds West a distance of 226.80 feet to a point in Robert Mears property (504/426); thence North 38 degrees 11 minutes 19 seconds East along said Mears southeast line a distance of 155.0 feet to a point in the Virgil Kuykendall property (500/528); thence South 45 degrees 28 minutes 53 seconds East along said Kuykendall’s southwest line a distance of 155.0 feet to a point in the centerline of Perry Road; thence South 29 degrees 44 minutes 58 seconds West a distance of 30.0 feet to a point; thence south 09 degrees 07 minutes 47 seconds West a distance of 140.0 feet to the point of beginning.

The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter than an accurate survey of the premises might disclose; and

All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.  The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
