NOTICE OF FORECLOSURE SALE

 

STATE OF TENNESSEE, TIPTON COUNTY

WHEREAS, Larry E. Davenport executed a Deed of Trust to Tennessee Housing Development Agency c/o First State Bank, Lender and J. Q. Edmonds, Trustee(s), which was dated March 2, 1990, and recorded on March 3, 1990 in Book 640, Page 457, in Tipton County, Tennessee Register of Deeds.

WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, Tennessee Housing Development Agency, (the “Holder”), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on August 13, 2019, at 12:00PM at the usual and customary location at the Tipton County Courthouse, Covington, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Tipton County, Tennessee, to wit:

 

Lot 20, Section “B”, McGowan Subdivision, Tipton County, Tn. as recorded in Plat Cabinet “B”, Slides 103 and 104, in the Register’s Office of Tipton County, Tn. and being more particularly described as follows: 

Beginning at a point in the north line of Billings Drive, said point being, 265.78 feet west of the west line of McGowan Drive, in the southeast corner of Lot 21; thence north 79 degrees, 32, minutes, 20 seconds east, a distance of 240.00 feet to a point at the end of a curve, to the left having a 25.00 foot radius; thence around said curve a distance of 40.04 feet to a point in the west line of McGowan Drive; thence north 12 degrees, 13 minutes, 49 seconds west a distance of 123.36 feet to a point in the southeast corner of Lot 31; thence south 79 degrees, 32 minutes, 20 seconds west a distance of 277.81 feet to a point in the east line of Lot 21; thence south 16 degrees, 49 minutes, 33 seconds east, a distance of 150.00 feet to the point of beginning.  

Being the same property conveyed to Grantor at Book 640 Page 455, of the Tipton County Register’s Office.

Current Owner(s): The Estate of Larry E. Davenport.

Other Interested Party(ies): Ford Motor Credit Company, LLC and Midland Funding, LLC as successor in interest to Chase Bank USA, N.A..

The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter than an accurate survey of the premises might disclose; and

All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.  The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
