NOTICE OF FORECLOSURE AND SUBSTITUTE TRUSTEE’S SALE

WHEREAS, default having been made by failure to comply with the terms and conditions of a Promissory Note dated April 2, 2002 executed by Kem Ralph and Roger Ralph and a Deed of Trust (the “Deed of Trust”) dated April 2, 2002 executed by Kem Ralph, Roger Ralph, and Ralph Brothers Farm, a Tennessee general partnership, for the benefit of SCRUGGS FARM SUPPLY, L.L.C. of record in Record Book 996, Page 347 in the Register’s Office of Tipton County, Tennessee (“Register’s Office”); as the current owner and holder of said Deed of Trust, Scruggs Farm Supply, L.L.C. appointed as Substitute Trustee, the undersigned, William P. WHEREAS, the entire indebtedness having been declared due and payable as provided in said Deed of Trust by Scruggs Farm Supply, L.L.C., and payment not having been made, notice is hereby given that William P. Seventh Tract: Beginning at a stake from which East 29links a 28 inch elm pointer being a corner of lots 4, 5 and 10; thence with the south line of Lot. No. 10 south 86-1/2 deg. E. 24.40 chains to a stake from which NW 18 links a ten inch hornbeam and southwest 15 links a 16 inch black gum pointer being the southwest corner of Lot. No. 10 and a corner of H. W. Sales Lot Nos. 5 & 6; thence with his line S. 2 deg. 12 min. W. 20.08 chains to a stake from which NW14 links an 8 inch red bud and NE 4 links a 4 inch poplar pointer being the NE corner of Lot No. 12 and a corner of H. W. The above tracts of land are tracts Nos. 4, 5, 6, 8, 9 10, & 11 of the survey made by J. A. Green, Surveyor, which survey with plat is of record in the Register’s Office of Tipton County, Tennessee at pages 434 to 438 inclusive of deed book 109 and are seven of the tracts conveyed to J. W. Sanders by Bessie Cobbs by deed dated Dec. 15, 1939 and recorded in the Register’s Office of Tipton County, Tennessee in Deed Book 195, Page 1.

 

However, there is excepted out of the above boundaries, the following:

 

1st. A roadway 15 feet wide along the whole east side of said lots No. 8, 9, 10 & 11 of said survey, containing 2.28 acres more or less. .

 

2nd. A parcel of land lying in the extreme NE corner of said lot No. 8 of said survey being the same conveyed to School Directors by W. H. Coleman by deed dated Aug. 24, 1917 and of record in the Register’s Office if said Tipton County, Tennessee in Deed Book 222, page 437 and bounded as follows:

3rd. A parcel of land now used for road purposes, title to which was divested out of J. W. Sanders and wife, Myrtle O. Sanders and vested in the County of Tipton, State of Tennessee in the cause of Tipton County v. J. W. Sanders et al in the Circuit Court of Tipton County, Tennessee and thus described:

East with a line southeast of, parallel to and 80 ft. from survey centerline 1990 feet + to a stake; thence north 3 deg. West 5 feet + to a stake; thence north 40 deg. 52 min. East with a line southeast of, parallel to, and 75 ft. from survey center line 2300 feet + to a stake; thence south 49 deg. 08 min. East 50 feet + to a stake in the west right of way line of a gravel road, thence north 1 deg. East with said right of way line 555 feet + to a stake; thence south 40 deg. 52 min. West with a line northwest of, parallel to, and 222 feet from survey center line 265 feet to a stake; thence

South 49 deg. 08 min. East 147 ft. to a stake; thence south 40 deg. 52 min. West with a line northwest of, parallel to and 75 feet from survey center line 2300 feet + to a stake; thence north 3 deg. West 11 feet to + to a stake; thence South 40 deg. 52 min. West with the line northwest of, parallel to, and 85 feet from survey center line 2170 feet to + to a stake; thence South 49 deg. 08 Min. West 10 feet to a stake thence south 40 deg. 52 min. West with a line northwest of, parallel to and 75 feet from survey center line 550 feet + to a stake in the Fyfe-Sanders property line; thence south 3 deg. 15 min. west with said property line 120 feet + to the beginning, containing 19.15 acres, more or less. 

 

The above tract being designated as Tract No. 55 on the Plane and Specifications referred to in the petition in the above styled cause and designated as Project No. F-014-2 (15) See Minute Book 23 page 313 in the Office of the Circuit Court Clerk of Tipton County, Tennessee, and Deed Book 270, Page 548 in the Register’s Office of said County.

 

Tract No. 8: Beginning at a stake in the center of the old Turnpike, the northeast corner of the W. H. Coleman lands and running thence due south of the Coleman line 299 feet to a stake in the same; thence south 69-1/2 deg. West 299 feet to a stake; thence the north 299 feet to a stake in the center of the Turnpike; thence with the corner of the pike to the point of beginning, containing 2 acres, more or less.

 

However, there is excepted out of the above (Tract No. 8) all that part of said tract which lies in the right of way of State Highway No. 54 on the north and the gravel road the east side of said tract. 

 

The above tract being the same conveyed to John W. Cook and Charles F. Cook by Myrtle Sanders by deed dated January 29, 1968 and recorded in Book 293, Page 648 in the Register’s Office of Tipton County, Tennessee.  

 

Parcel 3: Tax ID No. 044 013.00

 

Beginning at a stake which north 68-1/2 links a 12 inch ash pointer, being the northwest corner of Lot No. 6; thence south 86-1/2 east 24.75 chains to a stake from which northeast 6 links, a 6 inch elm and southwest 9 links a 5 inch black oak pointer, being a corner of Lots 6, 8 and 9; thence 2 east 28.78 chains to a stake in the center of the Pike, from which northeast 19 links a 5 inch black oak and southwest 14 links a 14 inch sweet gum pointer being the northwest corner of Lot No. 8; thence with the center of the Pike, south 69 west 26.88 chains to an iron stake in Fyfe’s east line from with southeast 18 links to a cluster of thorn pointers; thence with his line south 2 west 17.60 chains to the beginning, containing 57.39 acres.

 

But there is excepted out of the above lot of land the following tract:

 

Beginning at a stake in the center of a Pike the northeast corner of the original tract from which southwest a sweet gum stump, thence with said pike south 69-1/2 west 11.25 chains to a stake in the center of same; thence south 2 west 24.15 chains to a stake 12 links west of a small ash; thence south 86-1/2 east 10.25 chains to a stake form which northeast a 6 inch sweet gum and southwest 9 links a 15 inch beech pointer, being corner of Lots 6, 8 and 9; thence north 2 east 28.78 chains to the beginning, containing 27.37 acres, more or less. 

This sale is subject to any and all unpaid taxes, and any other prior claims, liens, easements, set back lines and restrictions.  In addition, the following parties may claim an interest in the above referenced property: Mary G. Ralph, Ralph Investment Services Trust, Kem Lott Ralph, Monsanto Company.
